No agreement: The dispute over the cinema at Sendlinger Tor continues

Munich – Shortly before the negotiation, the cinema operators received a “greeting”: “Dear Mr. Preßmar, in the old bond it would hurt my soul if your cinema had to close after 108 years. We are currently experiencing painfully like a virus all infested and can hardly be exterminated. The ‘Ruach’ is also such a virus that lives and thrives in the property owners and lets our Munich old town pearls die without giving them the necessary intensive care! I hope our favorite cinema can still be saved !!! Warm, painful, your Gerhard Polt “.

Owners of the movie theater want to avert eviction

Afterwards, the settlement date was negotiated in the Munich Regional Court, at which Fritz and his son Christoph Preßmar wanted to avert the eviction action against you for the film theater at Sendlinger Tor. Because the homeowners of the property want to get more money out of the property. The basis for everything is the lease from 1956. It also includes a monthly lease of DM 4666.66, the equivalent of around 2,300 euros, which results in an annual lease of less than 30,000 euros. Fritz Preßmar does not deny that this sum is too low. Rather, a second clause plays a role here, namely the sum is only the minimum rent. In fact, 14 percent of the cinema’s annual revenue is paid to homeowners.

Pressmars offer to triple the old minimum rent

The eviction prosecutors did not appear at the hearing, they only sent their lawyer. He calculated that the – funny-sounding – 4666.66 Marks would be adjusted for inflation and the equivalent of around 8,000 euros and not 2,300 euros. The Pressmars do not deny that either and have therefore offered to triple the old minimum lease and raise it to exactly the adjusted amount of 100,000 euros per year.

Of course, the corona year also played a role in fueling the lease dispute that had been going on for eight years. Because the cinemas had been closed for months, the 14 percent share in sales suddenly fell below the minimum rent of 1956, which had never happened before. “Instead of paying the minimum monthly sum of 2,300 euros, we voluntarily paid 5,000 euros with reservations. We would no longer demand this voluntary additional payment if an agreement were reached,” says Fritz Preßmar.

So far, no agreement has been reached in the dispute over the cinema

Since the settlement date ended without a judgment or agreement, the further negotiation was set for April 16. If no agreement can be reached by then or the homeowners do not respond to the proposal of the new minimum lease of 100,000 euros, if the 14 percent turnover share is lower, judge Marco Ottaviano has promised a ruling on the eviction action. Or: obtaining an expert report on the value of the leased property.

“Only,” says Fritz Preßmar: “At the moment this is difficult because real estate and rental prices in the city centers and also in Munich are currently changing extremely. In any case, the Pressmars want to exhaust all legal remedies in order to keep the film theater at Sendlinger Tor as a cinema. At the beginning of the district court, people almost got expelled from the room. Not because of disruption, but because the number of spectators almost went beyond the scope of the corona requirements. That in turn is no wonder, after all, the cinema is a piece of old, traditional urban culture, for the preservation of which a petition with 10,000 signatures was handed over to the state parliament last Thursday.

“Bully” defends the film theater: “It represents cinema in its perfect form”

Since then – in addition to Gerhard Polt – several other celebrities have stood behind the cinema. “Alfred Hitchcock already said what matters: ‘Right place, right time, right party!’ The Sendlinger Tor film theater should therefore stay exactly where it is. It is not a soulless display station for films, it has made history and represents cinema in its perfect form! “, Wrote Michael Bully Herbig to the Pressmars.

And Simon Verhoeven adds: “The Sendlinger film theater has been one of my favorite cinemas since childhood. Its painted posters are well-known in the city, its unique flair, its warmth and elegance, testify to a love for culture and cinema that only very few places in our city embody If this wonderful piece of Munich were to die, it would be an irrevocable shame for the whole city. ” There is nothing to add.
