Neighbors accuse Dafinka Beleva of embezzling BGN 23,000, she is adamant that she did not do it and was an honest housekeeper
The civil case of the Condominium property of block 75 in the Burgas residential complex “Lazur” against the former housekeeper Dafinka Beleva may take an unexpected turn due to a strange ruling by the Court of Appeal in Burgas, neighbors warned.

An unusual request, which lawyers say contradicts the Condominium Act, is about to lead to the termination of the case that the neighbors are bringing against Beleva. The court insists that each owner of an apartment (108 in total) submit to the court the specific amount that he claims to be reimbursed, as well as evidence that he has paid, which is controversial to say the least, say lawyers consulted by Flagman.bg. In addition, the claimed amount also includes the money that the block received from the rent of an antenna of a mobile operator.
After such evidence was not presented, the Court of Appeal in Burgas invalidated the decision of the BOS and closed the case. The condominium has appealed the ruling to the Supreme Court of Cassation. By a decision of a three-member panel of the Supreme Court of Appeal from yesterday, the ruling was annulled and the case was sent back to the Court of Appeal for adjudication. The Supreme Magistrates found that the Court of Appeal in Burgas did not have the right to terminate the appellate proceedings and it was decided to issue a decision.
We remind you that at the first instance – the Burgas District Court, the condominium of block 75 in the “Lazur” residential complex condemned Dafinka Beleva to pay BGN 23,542, excluding court costs, because she could not account for income and expenses in the period of January 1, 2015 – December 1, 2019. The court’s decision was solid, well-argued, and between the covers of the case it then became clear that Dafinka Beleva did not provide serious evidence, but only loose sheets without legal value.
