Mattarella: “The role of the magistrate must always be carried out with autonomy. Still few women in administrative justice”

“I am sure that you will always keep in mind that the function of the magistrate must be exercised in an autonomous and impartial manner, adopting decisions with a solid legislative foundation; that they know how to take into due account the condition of the people and the administrative and economic reality on which they are destined to have an impact. Best wishes to all of you: the Republic expresses its trust in you and counts on your commitment”. It is the message of the President of the Republic, Sergio Mattarellain the meeting at the Quirinale with the winners of the competitions for state councilor and TAR referendum.

A meeting which, as Mattarella recalls, “takes place in the fiftieth year since the TAR came into operation. The institution of the TAR was carried out in coherence with the autonomist principle affirmed by Article 5 of the Constitution but has, above all, contributed to the consolidation of the republican system, placing itself at the conclusion of a phase of legislative interventions aimed at the complete implementation of the constitutional principles relating to the full protection of subjective legal positions, as provided for in Article 24 of the Constitution. The development and completion of the administrative justice system, gradually ensured by the Republic, has marked a progressive strengthening of democracy, through the subjection, in an increasingly penetrating manner, of public power to the legitimacy control of the administrative judge – continues Mattarella during of the meeting – Through the administrative judge, the citizen asserts the responsibility of the Administration and sees the full protection of his subjective legal positions affected by the exercise of public powers ensured”, adds the President of the Republic. Who also underlines how, “in 2023, the Council of State and the regional administrative courts have achieved, well in advance, the objective of reducing the backlog which the Pnrr requires to be achieved by 2026”.

Then a reflection and a wish: “We recently celebrated March 8th. The presence of women in the administrative judiciary is still significantly lower than that achieved in the ordinary judiciary. I hope that the trend towards growth of the female component will be confirmed in the years to come come”, concludes the head of state.
