The Community of Madrid continues to accumulate most of the total criminal investigation proceedings opened by the Prosecutor’s Office for the commission of possible crimes in nursing homes as a result of the pandemic by covid-19, 82 out of a total of 176, according to the latest data provided by the Public Ministry, which also includes the referral of some of these matters to the courts for investigation, which now number 6 in this territory.
The total of procedures of this nature that are already investigated by judges from all over Spain are 22, a number of open cases that has been maintained in recent weeks. As for civil proceedings, the FGE reports that more than 170 remain open throughout the territory, a number also similar to last week.
In Madrid, the one that gathers the greatest number of proceedings is the Madrid Prosecutor’s Office, which has already accumulated more than fifty, in addition to the work that the Prosecutor’s Offices in the Getafe-Leganés, Móstoles-Fuenlabrada area are carrying out and Alcalá de Henares, reaching a total of 82 cases at the moment, to which must be added the 6 judicialized.
One of the judges to whom the clarification of the circumstances for the death of the elderly in a residence has fallen is precisely the head of the Court of Instruction number 51, Carmen Rodíguez-Medel, who is also investigating the Government delegate in Madrid for an alleged prevarication by allowing the manifestation of 8-M in the capital.
In Catalonia, thirty criminal procedures are still exceeded in the Prosecutor’s Office, a total of 16 in the Barcelona Prosecutor’s Office, most of them filed by family members, although it also appears in the statistics released this Wednesday by the State Attorney General’s Office (FGE) a complaint from the Covid-19 affected group, another as a result of the communication from the Catalan Professional Group of Directors of Centers and Services for Dependency Care (ASCAD) and another investigation opened after the communication from the Civil Registry of Sant Boi de Llobregat for deaths in four specific residences.
To all of them are added five different investigations in the Prosecutor’s Office of the Granollers Area, one in the Manresa-Igualada Area; five in the Sabadell area, one in the Terrasa area, two in Mataró, and one in the Tarragona Provincial Prosecutor’s Office. There are two ongoing judicial proceedings, one in the Investigating Court number 4 in Sabadell and another that is being carried out by the Court number 4 in Cerdandyola del Vallés for alleged crimes of falsehood in an official document and omission of the duty of relief.
FIRST CAUSE IN ANDALUSIA
In the latest statistics, there has been a novelty in Andalusia, a region that despite its size had been exempt from this type of research. Thus, the Cádiz Provincial Prosecutor’s Office has initiated an investigation following the complaint by an association that had been initially presented to the chief prosecutor of the Jerez area.
By number of investigations, Madrid and Catalonia are followed by the two Castillas, with twenty cases in Castilla y León and 18 in Castilla-LaMancha, followed by Galicia with 14 cases and Extremadura with 5. CONTROL FROM THE CIVIL FIELD
As for civil proceedings, the FGE reports that more than 170 remain open throughout the territory, number similar to last week. He indicates that two have been filed in the town of Alcoy, as the “absence of situations of neglect, abandonment or irregularities in the residences under monitoring” has been verified.
In addition, it adds that three new civil files are initiated for follow-up. In this case, these are open files to follow the situation of residences in the provinces of Cádiz and Alicante, and in the Region of Murcia.
The Prosecutor’s Office notes that the rest of the civil proceedings are still being processed in the different territorial prosecutors offices, and they explain in their statement that this week the receipt of updated information on the residential establishments under monitoring is recorded. They stand out for the number of proceedings pending Catalonia with more than 60 open, Castilla y León with more than 20, Andalusia with 16 or the Valencian Community with 19.
