List of Sanctions for PNS Skipping Work Version of Jokowi’s New Rules

President Joko Widodo issued a new policy that regulates the work discipline of civil servants (civil servant) in government circles. In Government Regulation Number 94 of 2021, civil servants who skip work and are not neutral in elections can be dismissed.

Dismissal sanctions are severe sanctions imposed on civil servants who violate the provisions on neutrality and discipline.

The provisions for severe sanctions for non-neutral civil servants are regulated in article 14 which reads, “Severe disciplinary penalties are imposed for civil servants who violate the provisions prohibiting providing support to presidential/vice presidential candidates, regional head/deputy regional head candidates, candidates for DPR, DPD, or other candidates for members of the Legislative Council.”

Meanwhile, the types of severe sanctions for civil servants who violate these rules include, among others, demotion to one level lower for 12 months; release from his position to become an executive for 12 months; until the honorable dismissal not at his own request as a civil servant.

The forms of violation of neutrality in question include participating in a campaign by deploying other civil servants; campaigning using state facilities; make decisions and/or actions that are beneficial or detrimental to one of the pairs of candidates before, during, and after the campaign period.

The neutrality of civil servants in every election event is often in the spotlight. The State Civil Apparatus Commission (KASN) noted that 492 civil servants violated neutrality in the 2020 Pilkada, but only 256 or around 52 percent had been sanctioned by the Civil Service Supervisory Officer (PPK).

In addition to civil servants who violate neutrality, severe sanctions can also be imposed for civil servants who violate attendance discipline. This is regulated in Article 11 paragraph (2) letter d number 3 PP Number 94 of 2021.

“Respectful dismissal is not at his own request as a civil servant for civil servants who do not come to work without valid reasons cumulatively for 28 (twenty eight) working days or more in 1 (one) year,” the article reads.

Dismissal–though with respect–can also be imposed on civil servants who have not come to work for 10 consecutive days. However, in addition to dismissal, severe sanctions can also be in the form of demotion one level for 12 months if absent for 21-24 days a year.

Then, if they do not enter for 25-27 days for a year, civil servants are released from the executive position for 12 months.

In addition to severe sanctions, there are also light and moderate sanctions for civil servants who violate attendance discipline. Starting from cutting performance allowances for civil servants who have been absent for two weeks, verbal and written warnings, for civil servants who are absent for 3-10 days.

“PNS who do not come to work and do not comply with the provisions of working hours without valid reasons continuously for 10 (ten) working days as referred to in Article 11 paragraph (2) letter d number 4) have their salaries paid from the following month,” Article 15 paragraph (2) of PP Number 94 of 2021 reads.
