Lebanon: presidential pardon for a prisoner who died 14 months ago!

It is disconcerting that the country has been studying a general amnesty for prisoners in Parliament for five years, with the aim of alleviating overcrowding in prisons that have exceeded their capacity. The Lebanese searched for the names of those who were pardoned and the images of the three decrees released on social media following media rumors were signed by President Michel Aoun, Prime Minister Najib Mikati and Justice Minister Henry Khoury, and they were issued on October 20, 2022. The decree, signed by Aoun, Mikati and Khoury, provides for a special amnesty that allows three people to be exempted from the remaining sentence.

The decrees belong to Muhammad Ahmad Al-Hassan, Salim Joseph Nasser and Ali Hassan Rabah. It is interesting to note that the three are criminally convicted, according to the text of the decrees of grace. It turned out that Rabah was sentenced to life in prison for a drug offense.
According to the law, the offender cannot refuse to benefit from a special pardon which can be suspended under one or more conditions, such as the provision of a precautionary guarantee, the treatment or compensation of the applicant, and within two years, if the offense is a crime, or six months if it is a violation. If the offense is a crime, the personal plaintiff must be compensated within a maximum term of 3 years, also pursuant to article 152 of the criminal code.
