Lawyer Seizes Schönbrunn Palace and Austrian Federal Chancellery Over Unpaid Debt

The Republic of Austria owes a lawyer from Vienna 1,346 euros. That’s why the lawyer had the Austrian Federal Chancellery and Schönbrunn Palace seized.

Schönbrunn Palace is one of the most famous sights in Vienna. Owned by the Habsburgs since 1569, the wife of Emperor Ferdinand II had a pleasure palace built on the site in 1642 and called the property “Schönbrunn”. Maria Theresia had the magnificent building fundamentally redesigned in 1743. The baroque palace and its magnificent gardens as well as the historic zoo attract millions of visitors from all over the world every year. Today the castle with its 1,441 rooms is a UNESCO World Heritage Site.

However, lawyer Wolfgang Andreas von Orsini and Rosenberg from Vienna did not let this stop him. The Republic of Austria owed the lawyer 1,346.40 euros for procedural costs incurred in connection with a court dispute before the Administrative Court over Corona aid. In order to collect the money, the lawyer had a simultaneous mortgage registered on the Austrian Federal Chancellery and Schönbrunn Palace.

After the lien was entered in the land register, the Republic of Austria paid the court costs. According to the lawyer, only the sum of 322 euros is now open for the execution proceedings. By the way, in Austria, execution does not mean the execution of a person. Rather, execution is a legal term that describes the use of state coercive power to enforce enforceable demands and claims.

In addition, the lawyer has now made it clear that he does not actually plan to auction the buildings. According to media reports, the Republic of Austria had previously admitted that it had not met the payment deadline. The lawyer was therefore in the right – even if his seizure intention was unusual.

Seizure of the State Chancellery and aircraft

Could the Federal Chancellery or Neuschwanstein Castle be seized in Germany? Theoretically yes – but the hurdles for this are very high. At least on a smaller scale, strange seizure procedures have also become known in Germany.

For example in one labor court proceedings against the state of North Rhine-Westphalia. A lawyer obtained a legal, enforceable settlement of 20,000 euros for his client. Despite several requests for payment, the country did not pay for almost three months. The lawyer then applied for the seizure of the North Rhine-Westphalian State Chancellery. Alarmed by the seizure announcement, the country then paid. Seizure just averted.

And aircraft are also regularly seized in the EU – mostly in connection with compensation under the Air Passenger Rights Ordinance. Namely whenever an airline does not pay and there is an enforceable title. In one Case against Condor A passenger won a lawsuit for payment of 600 euros because of a flight delay. The bailiff had already requested permission to enter the tarmac to carry out the seizure when the airline paid at the last minute.
