Jokowi Signs Job Creation Peru, KSPSI: President has betrayed the constitution

TIME.CO, Jakarta – The All Indonesian Trade Union Confederation (KSPSI) called President Joko Widodo (Jokowi) betrayed the constitution by signing it Government Regulation replacing the Act (Perpu) number 2 of 2022 relating to the creation of jobs or Job creation Peru. According to them, Perpu’s issue violated the rules of the Constitutional Court (MK).

This was decided during the 6th plenary meeting of the KSPSI Central Leadership Council (DPP) in South Jakarta on Monday, January 2, 2023.

The MK (Constitutional Court) decision of November 25, 2021 stated that the law on job creation must be corrected by repeating the procedure for its formation, i.e. by absorbing people’s aspirations. But in the repair process, KSPSI said, it apparently hasn’t been done for more than a year.

“If there are good intentions, from the date the Constitutional Court decides, the government and the DPR can make improvements immediately,” KSPSI said in a written statement on Tuesday, January 3, 2023.

Furthermore, KSPSI said that the decision of the Constitutional Court was an official decision of a high state institution which was not implemented by President Jokowi.

KSPSI also believes that the president has cheated constitution because formally, Perpu n. 2 of 2022 concerning job creation clearly violates Perpu’s issuance procedure. “Because it does not meet the requirements under Article 22 of the 1945 Constitution in conjunction with Constitutional Court decision number 138/PUU-VII/2009,” KSPSI said in a written statement.

KSPSI believes that the Constitutional Court’s decision essentially states that the Job Creation Law must be corrected, not replaced with a new Perpu whose substance is the same as the Job Creation Law. KSPSI sees that the Job Creation Perpu, especially in the employment sector, contains regulations that are worse than the Job Creation Law or have much worse meanings than the Law No. 13 of 2013 on Manpower.
