It rains complaints about the three years – Employers do not apply – 2024-03-09 05:20:29

Extortion practices, threats, arbitrary and unjustified layoffsmodifications of atomic contractseven moving workers around the country, many companies move in order to avoid paying the three years to the workers or to discourage them from asserting their rights.

These practices are officially denounced by the Federation of Private Employees of Greece, while the existence of the problem is also acknowledged by the Minister of Labor, Mrs. Domna Michailidou which reiterates that “the payment of the three years – to those who are entitled to them – is mandatory and not optional”.

Problem

It is not up to the good will or the good mood of the employer, adds the Minister of Labor, the specific increase must be paid.

However, only the continuous official statements of government actors on this matter show that there is a problem in the labor market with the application of the three years.

The largest trade union Federation of the country, that of private employees, refers to this issue. He talks about “extortionate practices” by employers in order to avoid paying the three years. They mainly come from but are not limited to contracting, custodial and cleaning companies. What practices listed by the Federation:

  1. A number of companies proceed with arbitrary and unjustified dismissals of employees – mainly those with work experience before 2012, which was frozen with the 6/2012 PYS. Once these employees show their badges to enforce the law and receive their raise, they are summarily out of the company.
  2. Other companies apply the practice of amending individual employment contracts, according to which the basic salary is defined as the minimum salary without three years, plus an “additional payment” as a voluntary benefit. Of course, there is the well-known condition that the voluntary provision can be freely revoked by the employer at any time, or it can be offset by any increase in wages or benefits, which will be granted by law or other legal provision.
  3. Several companies, in the amendments to the individual contracts, take care to add a condition of obligation of the employees, to move for work in “available” jobs throughout the country, otherwise they are threatened with dismissal.

According to the Federation, these practices aim to avoid the mandatory payment of the three years and to discourage employees from claiming them. In the next period, the trade union will address the Body of Labor Inspectors, presenting specific data in order to be checked, “so that these unacceptable practices can be stopped”.
