A driver from North Rhine-Westphalia is said to have damaged his expensive sports car in Brauselaystrasse in Cochem. The car insurance is now claiming the repair costs back.
According to the first reports in the weekly mirror, the driver’s insurance is to blame for the damage. According to the insurance company, the road was said to be in poor condition at the time of the accident. The owner of the Ferrari F40 is a motorsport enthusiast entrepreneur and vintage car collector from North Rhine-Westphalia. According to the Koblenz Regional Court, the left, front front mask of the car was damaged in the incident.
Process could solve a fundamental problem
According to Wolfgang Lambertz, Mayor of the Cochem Association, Brauselaystraße is a very narrow and old street with a slight gradient. If you drove into the street, you could see the road damage. “The process is exciting for the association,” says Lambertz, “because it is also about clarifying a fundamental problem.” The question is when a municipality has to be liable for such damage because of bad roads – and when not.
Damaged sports car is a top Ferrari model
The insurance company is suing the association for repair costs of around 62,000 euros plus legal fees. Such a sum is quite realistic for such a car, says Jens Wilhelm from CPI Sportwagen in Mülheim-Kärlich. According to the auto expert, the Ferrari F40 is one of the top models from the Italian automaker. They were only produced in small numbers.
