The Settlement and Arbitration Center of the Egyptian Olympic Committee announced the nullity of the current Zamalek club regulation and its implications, according to a decision issued yesterday, Wednesday, to come days after the suspension of Mortada Mansour, Chairman of the White Club, by the Olympic Committee.
According to the ruling of the Settlement and Arbitration Center, Hani Al-Attal will return to the position of Vice President of Zamalek again, with Abdullah George in the membership of the Board of Directors.
The nullity decision includes all the effects of the list, including the by-elections that were previously held and following which each of Ahmed Murtada Mansour, Hamada Anwar, Ahmed Adel Abdel Fattah was elected to the board of directors, and Ashraf Zaki as treasurer.
According to the decision, the Zamalek club will return to work according to the old regulation requiring the presence of a president, two deputies, a treasurer and five members of the board of directors, so what does the old Zamalek list say?
The Zamalek club elections, which were held on November 23 and 24, 2017, resulted in Mortada Mansour winning the president’s seat, and his list won all the seats except for Ahmed Mortada Mansour, who lost the membership to Hani Al-Attal.
Murtaza Mansour announced, hours after winning the elections, that the board of directors would be frozen in order to reject the presence of the porter.
After announcing his candidacy for the position of deputy, Mortada Mansour Al-Attal was accused of forging his official papers related to his university qualification, and he escalated the case to the Sports Arbitration and Settlement Center, which excluded the porter from the elections before returning him again after considering the substantive part.
Special regulation
Zamalek’s special list, which was voted on on August 25, 2017, in which 10 thousand members took part, and 7455 of them agreed in exchange for 2409 who refused to grant the club the right to authorize one of his deputies to manage the club’s affairs or choose someone to compensate for his absence.
The Zamalek special regulation grants all the competencies to the club president, and Article 35 specifies it as:
Article 36 granted the club president and the board of directors to define his powers.
Article 36, with its definition and its first and second paragraphs, will prevent the porter from exercising his duties, which may all be transferred to Ahmed Jalal Ibrahim by the decision of the club president or the majority of the council that Mortada controls, which means that the porter may be frozen in his position, to which he returned, in a more accurate sense, without powers.
Membership revocation
This is not only all that faces the porter, but the old list, specifically the first clause of Article 18 of the Zamalek special regulation, gives the club president the right to call for an extraordinary general assembly in case of extreme necessity, the sentence that is not restricted to specific cases.
The first clause of Article 20 specifies revocation of membership for all or some of the board members within the powers of the extraordinary general assembly.
The first clause of Paragraph 19 requires the attendance of 10,000 members in the extraordinary general assembly, and the percentage of two-thirds of those attending has been determined to be about (6667) to approve the decisions.
Mamdouh Abbas, the “al-Muhtakim,” filed a lawsuit against both Hisham Hatab, the head of the Egyptian Olympic Committee, the “arbitrator against him,” and Mortada Mansour, president of the Zamalek Club, an “offensive interventionist”, against the Olympic Committee’s decision to adopt the amendments to the Zamalek list in 2018, in violation of the Egyptian Sports Law of 2017.
The Settlement and Arbitration Center of the Committee decided to cancel the Olympic Committee’s decision to adopt the amended statute of the Zamalek Club on 1/6/2019 and its implications.
The Egyptian Olympic Committee is studying the ruling through a legal committee to look into whether or not to challenge it in accordance with the regulations of the statute of the Egyptian Sports Settlement and Arbitration Center issued by Resolution No. 88
