Hassan M. Acquitted by Court for Threats at Sarcelles Synagogue: Administrative Detention Imposed

Hassan M., 28, acquitted by the criminal court which tried him Monday evening for threats in front of the great synagogue of Sarcelles (Val-d’Oise), was placed in a detention center as soon as he left the Pontoise courthouse , “for the purposes of his removal” indicated this Tuesday morning the Val-d’Oise prefecture. He then ran away, pursued by the two security agents before returning to the synagogue. He was then arrested by the mobile gendarmes mobilized for security. In police custody then before the judge of liberty and the court, he contested his action amid provocative, insulting or incomprehensible remarks. Back in the box during the deliberations, he clapped his hands.

Found not guilty

Prosecuted for death threats due to religion, he was finally acquitted in the evening, the court having considered that the offense was not sufficiently serious, due to the absence of words spoken during the gesture. What the defense successfully argued. The court specified that it was up to the Ministry of the Interior to do what was necessary regarding the administrative measures in progress.

The prosecutor, for her part, requested 8 months against him and a warrant of committal, considering that the gesture made in the current context could only be interpreted as a death threat. Moïse Kahloun, the president of the Jewish community of Sarcelles, confided at the end of the hearing his fear of seeing a young man who had spent several stays in a psychiatric hospital commit acts, about which the expert noted episodes of “psychotic decompensations” while not retaining any abolition or alteration of discernment. “This is what is all the more dangerous,” said Moïse Kahloun, who hoped at the end of the hearing for rapid intervention from the State to expel the young man.
