The Labor Cassation Chamber of the Supreme Court of Justice decided, in second instance, to revoke the guardianship that ordered President Iván Duque to erase a trill about the Virgin of Chiquinquirá.
Duque had celebrated the 101 years of the Virgin with a message that one plaintiff considered “proselytizing in favor of a religious cult.”
This was his trill: “Respecting the religious freedoms of our country and in clear expression of my faith, today we celebrate the 101 years of the recognition of our Virgin of Chiquinquirá as Patroness of Colombia. Every day in deep prayer I thank him and ask him for our country ”.
The plaintiff then succeeded in getting the Superior Court of Cali to admit the guardianship and order the head of state to erase the trill.
This Thursday the case took a turn, as the Supreme Court of Justice revoked the guardianship, considering that “it manages to remain as the expression of an individual sentiment of its Catholic beliefs, which did not have enough entity to compromise the secular position of the State it represents. , as it did not materialize in any official conduct or policy tending to favor or benefit in any way the practitioners of the Catholic religion or the institutions that are part of said creed.
However, he called for the “proper use of each of the accounts, personal and institutional, of the Presidency of the Republic, in order to disseminate in the latter all matters derived from the public function. Likewise, to avoid referring to internal matters that could be interpreted as an official position, while the use of the internet tends to be more and more extensive and social networks are open discussion forums, which undoubtedly leads to the public scrutiny of their publications is increased ”.
