Guardianship ruling orders compliance with short vaccination interval

The Sixth Civil Court of the Bucaramanga Circuit ordered the Ministry of Health Yet the Guane Clinic from Bucaramanga, apply within 48 hours the second doses of the vaccine against the COVID-19, to two inhabitants of that city.

It is a guardianship ruling in which the judge also considered that there is no scientific evidence to support the decision of the Ministry of Health to extend the interval to complete vaccination schedules from 28 to 84 days.

What happens if a guardianship comes where all Colombians file guardianships in this regard? The principle of equality would be in danger because this principle must be weighed against the right to individual health”.

The jurist considered that “If individual vaccines are started to be given to people through guardianship, the equality that exists in the scheme that has been organized up to now is broken”.

In the judgment of guardianship, the judge indicates that “no other authority may contravene the indications or prescriptions of the laboratory to modify the application periods”.

In addition, the judge warns that “altering the manufacturer’s indications of a drug implies putting the patient’s health at risk”.

Consequently, the judge upheld with this decision the fundamental rights to health and life of Rafael Felipe Montero and Camilo Andrés Montero, who have already received their second dose.
