According to the court, the fourteen-year sentence is perfectly appropriate, as is the subsequent pre-trial detention.

“Mr. Defendant undoubtedly suffers from severe antisocial personality disorder and thus the conditions are in place for the imposition of security detention,” Hodoušek said, adding that this does not automatically mean life imprisonment, because detention may be revoked depending on the circumstances.

Nosek stabbed his 18-year-old friend at Easter 2017 in the center of Varnsdorf, near the Mandava River. The stabbing of a twenty-centimeter knife under the young man’s ribs preceded the conflict, according to Nosk, he and his friend first quarreled, and the quarrel turned into a physical conflict. It is said that Nosek went for a walk in the evening and met a group of friends who were drinking at the playground. So he joined them.

Later, he allegedly accompanied a drunken friend home and stabbed him after a verbal argument. “I put a knife to the gnaw of his neck. He started attacking even more, I dodged and stabbed him in the right side, “he said, noting that he was not interested in another friend’s fate.

Nosek escaped from the scene, but the police soon caught him and found the murder weapon hidden in his home.

The young man then tried to hang himself on the sheets and ended up in psychiatry. There, experts came to the conclusion that he suffered from a mental disorder, specifically developing schizophrenia.

At first just detention
Due to this, the court stopped Nosk’s prosecution in the autumn of 2017 and sent him to security detention.

But during Nosk’s stay in a psychiatric hospital, doctors discovered that the young man was not behaving in accordance with the diagnosis. He also reacted differently to the medication than would correspond to the given diagnosis. The Public Prosecutor’s Office therefore filed a motion to reopen the proceedings. The review report then showed that Nosek did not meet the criteria for schizophrenia, so there was no reason to stop his prosecution.

During the renewed proceedings, the Ústí nad Labem Regional Court ruled on the basis of an audit report that Nosek was not insane at the time of the crime and imposed a 14-year sentence on him. After its execution, Nosek will go to security detention indefinitely. At the same time, he must also compensate the murdered sister and his father with more than a million crowns.
