In its current judgment of 9 September 2022 on file number 19 U 309/21, the Higher Regional Court of Frankfurt am Main has decided that a customer of Mercedes-Benz Bank AG can use the so-called revocation joker to recover all interest paid on the its the financing of the vehicle and the expenses for an insurance policy stipulated can. In this specific case, this amounts to a payment of EUR 2,850.16 plus interest, which the plaintiff represented by HAHN Rechtsanwälte can now look forward to. Because the judgment is already final.
In October 2018, the chosen actor concluded a loan agreement for a total amount of € 49,350.16 to finance his car. The Higher Regional Court of Frankfurt am Main has ruled that Mercedes Bank has not adequately fulfilled its legal obligation to provide information on the right of withdrawal pursuant to Section 495 (1) BGB. The actor had even sold the vehicle. According to the High Regional Court, even this circumstance does not change anything about the possibility of annulment through revocation.
“Economically, a revocation or reversal can lead to consumer benefits, which can amount to up to 25% of the vehicle purchase price for diesel cars,” says lawyer Rugen.
