Doni Salmanan’s sentence was increased to 8 years in prison, previously it was only 4 years


KOMPAS.com – The High Court (PT) Bandung, West Java, increased the sentence of the defendant in the Quotex Binary Option investment platform fraud case, Doni Salmanan, in an appeal decision from four years to eight years in prison.

The appeal was filed by Doni Salmanan who did not accept being sentenced to four years in prison by the panel of judges at the Bale Bandung District Court.

The PT Bandung Panel of Judges decided to accept the appeal request and cancel the Bale Bandung District Court decision Number 576/Pid.Sus/2022/PN Blb dated December 15, 2022.

“The defendant was therefore sentenced to imprisonment for eight years and a fine of Rp. 1 billion with the stipulation that if the fine is not paid then it will be replaced with imprisonment for six months,” said the Panel of Judges chaired by Catur Iriantoro, as quoted from the website. In the decision at the Bale Bandung District Court level, Doni Salmanan was charged with Article 45A paragraph 1 Jo Article 28 paragraph (1) Law Number 11 of 2008 concerning information and electronic transactions (ITE) as amended and supplemented by Law Number 19 of 2008 2016 concerning amendments to Law Number 11 of 2008 concerning ITE.

Doni Salmanan was found guilty of spreading false, misleading news and causing consumer harm as stated in the first charge.

However, in the decision at the appeal level of PT Bandung, Doni was also found guilty of committing the crime of money laundering (TPPU) as stated in the second first indictment, namely Article 3 of Law Number 8 of 2010.

“Determining the detention period that has been served by the defendant is deducted in its entirety from the sentence handed down. Stipulating that the defendant remains in detention,” said the judge.

Previously, the Bale Bandung District Court decided that Doni Salmanan was sentenced to four years in prison and a fine of IDR 1 billion.

The sentence was lower than the prosecutor’s demand that Doni Salmanan be sentenced to 13 years in prison.

Chairman of the Panel of Judges at Bale Bandung District Court Achmad Satibi also previously decided that Doni Salmanan did not have to pay compensation to the victims because he was not proven guilty as in the indictment of the two public prosecutors regarding the crime of money laundering (TPPU).

“Therefore freeing the defendant from the second indictment,” said Achmad Satibi at Bale Bandung District Court, Bandung Regency, West Java, Thursday (15/12/2022).
