Four deaths at S. Rita in Milan, 21 years and 6 months at the former primary

Previously the Supreme Court had annulled the life sentence for the former primary, believing that the deaths of the 4 elderly people brought to the operating room for “useless interventions” were not “intentional murders”. The Milan Court of Assizes and Appeals has therefore re-qualified the murder charge, excluding voluntary and willful misconduct, and re-quantified the sentence for Brega Massone.

After three years, the former surgeon will not return to prison – Previously, the surgeon had been sentenced to 15 and a half years, which became definitive, for 55 cases of injuries and scams to the National Health Service. Now the judges have redone the calculation after the “stoats” had sent the documents back to their colleagues in the Court of Assizes of Appeal, deeming it necessary to challenge, in addition to the intentional murder, the aggravating circumstance of the purpose of profit. The overall sentence, with the constraint of continuation, was then recalculated by the Milanese judges at 22 years and 4 months which, due to the three-year sentence, dropped to 18 years and 4 months. Since the former head physician has already been in prison for 15 and a half years and the residual sentence is therefore less than three years, when the sentence becomes final, Brega Massone should end the sentence no longer in cell but in probationary custody. social services.

The Court also redetermined the 7-year and 8-month sentence imposed on Fabio Presicci, Brega’s right hand man and accused of two of the four deaths. Net of the amnesty and with the aggravating circumstance subvalent to the generic extenuating circumstances granted to him, the sentence is 8 years and 8 months, of which only 6 months to be served in foster care.

Sentences at first instance – In the first instance the two doctors, arrested 13 years ago and present in the courtroom to read the sentence, were found responsible for murder and were respectively sentenced to life imprisonment and 21 years. “It’s finally over,” commented Brega’s wife after reading the device. Presicci’s lawyer, Mauro Mocchi, said that “a very painful affair for everyone has ended”.
