“Denmark Court Denies Transgender Prisoner’s Request to Serve Sentence in Women’s Prison”

The 62-year-old man changed his legal gender from male to female in 2015, already serving a sentence for aggravated rape and other crimes.

A transgender person “will create security risks for female prisoners that are not insignificant,” according to the ruling of the Eastern High Court of Denmark on Wednesday.

The prisoner had sued the Danish Prison Service and Herstedvester Prison, but both the district and high courts ruled that she should serve her sentence in a men’s prison.

According to Danish law, the inspection of the prisoner during the undressing process is carried out by a person of the same sex.

As the court pointed out, the fact that such a search is carried out by men does not violate the law on the execution of punishment. This law is also not violated by passing a urine sample, with men supervising the process.

Gender in this law means biological sex, the court said.
