Defendant shows remorse – judge judges with “absolute special bargain”

After an accident escape in Kreuth, a Tegernsee (48) was now on trial. Because the man showed repentance, the judge closed his eyes.

Kreuth – Kreuth in December 2019: A couple with a child in a stroller crosses the street. Suddenly a car driver turns left, hits the stroller and drives away. The child suffers a slight contusion of the skull, and the mother is also bruised. This is what happened at the Wiesseer Strasse / Südliche Hauptstrasse intersection. At the wheel of the car was a Tegernsee (48) who had to answer for negligent bodily harm with unauthorized removal from the scene of the accident. The man’s main concern was his driver’s license. But he has to hand it over first.

“He’s really sorry,” said defense attorney Frank Weller right at the beginning of the trial against his client. On the said day, he turned left at the said point, “heard a blow”, said the lawyer, but then drove on. The blow, as it turned out, came from the mother, who hit the hood of the Tegernsee car with her hand after the accident had already happened. Weller continued: “After a few meters he turned around, but unfortunately he didn’t see the accident victims.” It was a bit dark, added the defendant. “I just didn’t see the stroller.” In the meantime, he has given the mother 250 euros in compensation for pain and suffering. The 48-year-old did not deny that the accident happened as described.

Tegernseer had never done anything wrong

The Tegernsee and lawyer Weller was primarily concerned with limiting the legal consequences. “He just needs his driver’s license for his job,” explained Weller. His client has never been guilty of anything. The federal central register as well as the fitness to drive register of the Tegernsee are blank.

The public prosecutor’s office acknowledged “that you have confessed and repented and have also paid pain and suffering.” Nevertheless, there would be no avoiding a driving ban here. The public prosecutor pleaded that the Tegernsee should not move a vehicle for three months. In addition, he should pay a fine of 70 daily rates of 35 euros each. “After all, we also have an injured child here,” she said.

“Without the accident escape, there would probably be an attitude,” said lawyer Weller. Nevertheless, the deeds cannot be dismissed out of hand. Weller asked for a lower fine of 45 daily rates of 30 or a maximum of 35 euros and not to issue a driving ban.

Regarding the fine, Judge Walter Leitner agreed to the prosecution’s plea. When it came to the driving ban, however, he met the Tegernsee: the 48-year-old is not allowed to drive for two months instead of three. “Yes, the injuries are minor,” said the judge. “Nevertheless, two people were injured and you left the scene of the accident.” When it came to the driving ban, Leitner immediately “turned a blind eye”, as he said. “This is an absolute special bargain.”
