However, this decision of CVK can also be challenged within three working days by submitting an application to the Regional Administrative Court. The decision of the district court, which must be made within seven days of receipt of the application, is final and not subject to appeal.

If the court, considering the complaint, finds that such violations of the law have been committed in organizing elections or counting votes and calculating election results that have affected the distribution of seats of the relevant council deputies among political parties, associations of political parties, it revokes the decision on municipal election results. In such a situation, the court may take one of the following decisions: order the CEC to ensure the transfer of votes, to announce a repeat vote or to announce a re-election.

The Republic City and County Council Election Law stipulates that if the election results are not contested, new deputies must be invited to the first council meeting not earlier than ten days and not later than 20 days after the announcement of the election results. In turn, in order to comply with the court judgment, which leaves unchanged the decision of the election commission to approve the election results, the chairman of the city election commission invites the newly elected deputies to the first council meeting within ten days after the court ruling.

Juris Kokins, the chairman of the Riga Election Commission, said that the situation when about 600 votes had to be declared invalid, due to which the results of the elections would probably be contested, arose because the district leaders had “missed” something. According to him, the electoral system does not need to be changed due to this situation.

Kokin also does not believe that he should resign or take political responsibility, because “I am neither an official nor a politician”.

It has already been reported that 419 unstamped ballot envelopes have been opened at the Pushkin Lyceum in the Riga polling station, which cannot be included in the election results. In Riga Classical Gymnasium, there were 208 such envelopes. It was decided to declare the unstamped ballot envelopes and the ballot papers contained therein invalid.

In both cases, the Central Election Commission (CEC) has already decided to ask the SLS to examine the circumstances of the case. As previously explained by the Chair of the CEC, only law enforcement authorities can investigate the circumstances, question witnesses and persons involved.
