Coronavirus, the new dpcm postponed by a week. But mandatory masks immediately

The government is aiming to postpone the dpcm by a week for the new ones rules against Covid. So it transpires, after a day of reflections and meetings. In the meantime, the dpcm currently in force would be extended by one week to avoid a regulatory vacuum. However, it is saved – and introduced as of tomorrow – the extension of the mandatory outdoor masks (albeit mitigated by some concessions of common sense). It will be included in the decree (HERE the text) with which the executive extends the state of emergency until January. In this way the executive takes time, evaluates the contagion curve, prepares for even more restrictive interventions if necessary, but after having agreed them with the Regions and having made the Italians “absorb” the need.

But how does this orientation arise? In addition to the reasons already stated, there is also a problem of timing: the dpcm currently in force expires tomorrow, October 7th. To make a new one, the state of emergency must be extended. The Council of Ministers will do so tomorrow, after having taken note of the resolutions passed by Parliament, those that have been postponed today due to the absence of a quorum in the Chamber. But the decree will be published in the Official Gazette no earlier than the day after tomorrow.

The effect is to override the expiry of the dpcm currently in force, or to issue a dpcm which could only be valid until October 15, the current expiry of the state of emergency. In this way, however, the executive will extend the state of emergency until January 2021, and under this decree it will be able to approve a dpcm with a longer deadline.
