CC orders Congress to “refrain” from including independent deputies in Block Heads – Publinews – 2024-03-07 20:34:06

The Constitutional Court, based on what is considered and the laws cited, resolves in one of its cited paragraphs that it be verified that the Board of Block Heads is made up of the block heads and sub-heads, so other people must abstain. to integrate and/or participate in any form- deputies who do not meet that quality.

Likewise, the document clearly details the request for assistance for the due execution made by Nidia Lorena De León Torres, in her capacity as Deputies to the Congress of the Republic of Guatemala, of the order issued by that Court on February 22 of this year, considered.

In the third point, it specifies that for due compliance with the resolution of that Court in the aforementioned provisional protection order, the following ordinances are issued:

“a) the questioned authority is ordered to issue the instructions that are necessary so that, in accordance with the provisions of paragraph three, literal B) of minute 9-2024 issued by the Board of Directors on February twenty-six, two thousand twenty-four,” he noted.

In light of the above, the court urged that the rest of the Caucuses and Deputies of the Congress of the Republic be made aware of the decisions made by the Legislative Block of Us and the Political Party of Us regarding who was designated as Head of the Block and as President of the Housing Commission from the date of presentation of these letters (February 8, 2024) with the purpose that the aforementioned bench can exercise the rights and activities guaranteed by the Political Constitution of the Republic of Guatemala and the Organic Law of the Legislative Body , relating to the exercise of legislative representativeness that corresponds to them as a block.

IN COMPLIANCE WITH ARTICLE 48 AND 50 OF THE LEGISLATIVE

In follow-up, the document in section (b) points out that the questioned authority is warned to comply with articles 48 and 50 of the Organic Law of the Legislative Body.

“Verify that the Board of Block Heads is integrated, as its legal provision indicates, with the heads and sub-heads of the block, so they must refrain from integrating and/or participating in any form – deputies who do not meet that quality”, he concludes.
