The planning approval decision of the Breisgau-Hochschwarzwald district office for the construction and operation of the Breisach / Burkheim flood retention area comprises just under 1100 pages. The competent water authority has now completed the procedure requested by the state of Baden-Württemberg. More than 3,000 private objections and statements from various public bodies and specialist authorities have been examined in the planning approval process and included in the decision. The objections and comments received during the hearing were discussed in public in March and November 2018.
The approved retention area extends to areas of the cities of Breisach am Rhein and Vogtsburg in the Kaiserstuhl as well as the municipality of Sasbach am Kaiserstuhl. It covers an area of 634 hectares with a retention volume of 6.5 million cubic meters. The components of the project that have been approved are the implementation of ecological flooding and the early flow of sludge in the retention area before the trial operation. The state gives the local communities the opportunity to actively participate in the entire process for early flow.
In its decision, the Breisgau-Hochschwarzwald district office issued, among other things, the necessary water and nature conservation regulations. As a project sponsor, the state is obliged to take protective measures. Among other things, groundwater wells will be built in the local area of Burkheim and in the area of the settlement area “Breisach-Jägerhof”, which can be used in future by the local communities outside of the operation of the retention area. Evidence-preserving measures with regard to cellar wetting and drinking water supply should also be carried out. Before the retention room is put into operation, the state must carry out an extensive trial run as a functional test. The state also bears the costs for the new construction of the SV Burkheim sports grounds at a new flood-proof location.
The public announcement of the planning approval decision is made on the website of the district office and by advertisement in the local press. After June 15, the documents will be laid out in the local communities of Breisach, Vogtsburg and Sasbach for a period of two weeks. The municipalities provide information on the local arrangements. At the same time, the planning approval decision and all planning approval documents can be viewed and downloaded on the website of the district office under the heading Service • Administration »Public Announcements» Nature and Environment »IRP Breisach-Burkheim. The appeal to the Baden-Württemberg Administrative Court in Mannheim is open to the planning approval decision of the Breisgau-Hochschwarzwald district office.
