Border guards will have to take an oath, the new law provides

Saeima supported a new one at third reading this week State Border Guard the law. It is designed to update the legal regulation of the border guard, as well as to ensure its coherence with other regulatory enactments and European Union legal norms, the portal “Delfi” found out in the Press Service of the Saeima.

The newly developed law preserves the already defined functions of the State Border Guard – ensuring the inviolability of the state border and prevention of illegal migration – while clarifying the tasks of the border guard. The law also provides for border guard co-operation with the European Border and Coast Guard Agency.

The law stipulates that the border guard will have the right to verify the identity of each person, as well as to withdraw invalid travel documents within the framework of the performance of official duties.

The law also provides for the renewal of the border guard’s oath, as well as for the lifting of the current ban on trade unions for border guards.

In accordance with the functions and tasks of the border guard, other rights and obligations set for the border guard have also been updated. It is also envisaged that they may be specified in other Latvian regulatory enactments. The law also updates the regulation relating to the use of physical force, fighting techniques and special means, the use of a service dog, as well as a weapon.

From now on, the border guard will have mandatory professional education in the field of border guard or special training of the border guard corresponding to the position to be held. The changes will apply to persons who have been accepted into the service of the border guard after the entry into force of the law, indicated in the annotation of the draft law.

The law also stipulates that each border guard will have to undergo special military training specially developed for the needs of the border guard. It will be possible to release a border guard who has previously successfully completed a military training course or equivalent training.

For a limited period of time, the border guard will be able to be appointed a soldier of the National Armed Forces (NAF) and transferred to the personnel of the NAF unit. The annotation of the draft law explains that the mentioned transfer will be possible, for example, to ensure high-quality professional training for border guards who perform special operations.

The Cabinet of Ministers has been delegated the determination of the procedure for the performance of the duties of a soldier, as well as the determination of the remuneration of a border guard, the wearing of uniforms and insignia, the performance of health checks, the calculation of service and disciplinary sanctions.
