Berlin court dismisses lawsuit by widow of asylum seeker killed in police operation

Around seven and a half years after a deadly police operation in a refugee accommodation in Moabit, the asylum seeker’s widow has failed in her lawsuit against the state of Berlin. The Berlin regional court rejected their claims, as a court spokesman announced on Wednesday after the second hearing.

The spokesperson did not give reasons why the trial in the civil case was dismissed.

The slain father’s wife had asked for at least 20,000 euros in compensation and damages for lost maintenance payments for their three children aged 10, 14 and 15.

Her then 29-year-old husband died on 27 September 2016 as a result of a police operation in the shared accommodation.

The police operation took place because a roommate had abused the six-year-old daughter of the man who was later killed. When the perpetrator was already sitting in the police car, the father jumped on him – with a knife, according to the police. Several officers drew their weapons and shot him. He died a little later.

The roommate whose actions prompted the operation has since been evicted. In 2017, the Tiergarten district court sentenced him to one year and eight months in prison for sexual abuse.

According to the Berlin public prosecutor’s office, three police officers involved in the operation were investigated for murder. According to authorities, the proceedings were halted in May 2017, citing self-defense and emergency assistance.

The man’s widow took legal action and went to the Constitutional Court of Berlin. After her constitutional challenge was successful, the Court of Appeal was asked again.

To this day there are doubts that the man was armed. In the civil trial, several police officers testified that they did not see a knife. The police officers at the center of the criminal investigation exercised their right to remain silent.
