Mr. Jean-Nol Gurini draws the attention of the Minister of Health and Prevention to the difficulties that the capping of temporary medical work in the hospital could cause.

Article 33 of Law No. 2021-502 of April 26, 2021, aimed at improving the health system through confidence and simplification, makes the cap on the remuneration of interim doctors’ guards effective. It is legitimately a question of putting an end to the prejudicial deviations of certain practices, burdening the budgets of public hospitals and leading to inequalities of treatment which discourage professionals in post. Originally, it was planned that from April 3, 2023, a doctor could no longer be paid above 1,170 gross for 24-hour call duty, under penalty of legal proceedings; this ceiling was finally raised to 1,390.

However, although necessary, the application of this measure could greatly destabilize the organization of certain services already under strain, such as emergencies, anesthesia-resuscitation or gynecology-obstetrics. Some 30% of the positions of hospital practitioners would indeed be vacant.

Faced with this serious shortage of caregivers, the remedy could therefore prove to be worse than the disease. This is why he asks her how to find the right balance and enhance the attractiveness of hospital careers.
