What to pay the king for the forbidden logging in his forests – the state will negotiate (Review)

SIMEON SAKSKOBURGGOTSKI

The Vrana Palace belongs to the royal family, the Sofia Court of Appeals decided less than a year ago.

So far, we are paying 5,000 euros in costs in the lost first instance.

Bulgaria appealed BGN 2 million in losses to Simeon.

The second instance court in Strasbourg dismissed the case

The Council of Ministers has appealed to the Grand Chamber of the European Court of Human Rights against Bulgaria’s condemnation of the moratorium on the king cutting down his forests. The appeal was not allowed to be heard by the second instance court in Strasbourg. However, the deadline for Simeon Saxe-Coburg-Gotha and his sister Maria Louise Hrobok to agree with the state on the amount of compensation has been extended.

On Thursday, the government decided to pay 5,000 euros in costs in a case the former prime minister and his sister won in a Strasbourg court. The amount was awarded by European magistrates, who, however

did not rule on the amount of compensation,

and they left it to the state and the king.

“Someone has to take the initiative – a representative of Simeon Saxe-Coburg-Gotha or the government,” said lawyer Mikhail Ekimdzhiev, who won the royal family’s case.

The court’s decision was made on September 7, 2021. According to him, with the moratorium of December 18, 2009, Simeon and his sister not only could not dispose of the property, but also to appeal the decision of Parliament. The judges did not award specific compensation for lost profits.

However, there was expertise in the case

According to her, the profit that Simeon and Maria Louisa Hrobok could have received from logging for the period from the entry into force of the moratorium until October 19, 2018, is 1,050,356 euros, or 2,054,319 levs.

Thus, around this amount can be bargained for the amount of compensation. Following the agreement, she was sent back to Strasbourg. So far no development is known.

With the so-called In addition to Strasbourg, the Constitutional Court and four Bulgarian courts – the Sofia District Court, the Sofia City Court, the Sofia Court of Appeal and the Supreme Court of Cassation – also dealt with royal estates. The court saga has been going on for ten years.

The royal family lost the hunting lodges “Sargyol”, “Sitnyakovo” and the farm “Vrana”, but won “Tsarska Bistrica”.

The case for the Vrana Palace is still pending, although on July 27, 2021, the Sofia Court of Appeals announced that it belonged to Simeon and Maria Louisa Hrobok. The decision of the Supreme Court of Cassation is pending. After the court ruled in favor of Vrana, the royal family issued a statement saying that the Bulgarian people would not pay compensation because there was no guilt that the property had been confiscated after 1946. “

The case for 16,500 decares of forests in Rila is still pending at first instance. But it is difficult due to very complex expertise.
