Verdict on parking on sidewalks: Bremen appeals

The Bremen transport department, in coordination with the interior department, is appealing against a judgment of the Bremen Administrative Court because of the parking situation. After a lawsuit by five Bremen residents, the court decided that the road traffic authority had to intervene against the cars that had been parked on both sides of the street in many parts of the city for years. In Bremen, this currently affects around 50,000 cars.

They appealed because the administrative court’s judgment was important for the entire city, said Mobility Senator Maike Schaefer and Interior Senator Ulrich Mäurer according to a statement. “If the Higher Administrative Court comes to the same conclusion, this will of course have an even greater impact on Bremen. In addition, there would be a broadcast for the whole of Germany, which is of great importance for the traffic turnaround, for accessibility and also for rescue safety,” said Schaefer. Because of the fundamental importance of his judgment, the administrative court had allowed an appeal.

What is special about the judgment is that the court established this subjective right at all, and that on public land, said administrative court spokesman Carsten Bauer. The administrative court had emphasized that the road traffic authority could not refer the plaintiffs to contact the regulatory authorities, since they usually did not intervene in the affected residential streets, so the plaintiffs were de facto without legal protection. The motorists concerned could not invoke a “customary right”.

“Basically, we agree that we need more accessibility and quality of stay in the densely built-up quarters; people are the focus of our actions and not the car,” said Schaefer. The situation is no longer tenable in many parts of the city, admits Schaefer together with Mäurer. Many residents would suffer from the fact that the sidewalks are often no longer usable. “On the other hand, we need alternatives. Just pulling off parked cars doesn’t get us anywhere: the vehicles don’t just vanish into thin air,” said Mäurer.

The senators think that the administrative court agrees with the joint plan of action for ‘Parking in quarters‘ gave too little importance. The concept – which is intended to counteract the parking pressure – can only be implemented together with the citizens, not against them. I therefore consider the decision of the administrative court to be completely unrealistic,” said Mäurer.
