Valid disqualification of Emilio Lozoya for 10 years

This Wednesday, the Superior Chamber of the Federal Court of Administrative Justice (TFJA) decided that the sanction imposed in May 2019 by the Ministry of Public Administration (SFP) is valid Emilio Lozoya Austin, former general director of Petróleos Mexicanos (Pemex), consisting of disqualification for 10 years to hold public office.

In public session, with eight votes in favor, two abstentions and zero against, the magistrates of the Superior Chamber of the TFJA determined that the disqualification against the Pemex extitular in the administration of Enrique Peña Nieto “It is attached to law” and, therefore, remains firm as long as there is no resolution to the contrary.

By virtue of the relevance of the case, the trial was attracted by the Superior Chamber of the TFJA from the Third Metropolitan Regional Chamber, where it was originally presented.

Given this resolution, Irma Eréndira Sandoval Ballesteros, head of the SFP, described this decision of the Court as “historic”, because it is the first time that the agency disqualifies a general director of a state-owned company, such as Pemex.

“The confirmation of this sanction is historic, as it is the first time that the Public function disqualifies an extitular from the State productive enterprise, which is a sample of the impartiality, rigor and adherence to the law with which this agency performs its work to guarantee an honest and effective government, ”he said.

The sanction against Lozoya Austin, who is wanted by judicial authorities, derived from investigations conducted by the SFP finding that he provided false information in his statement of Patrimonial situation, having omitted, on more than one occasion a bank account that recorded balances of hundreds of thousands of pesos.

The SFP said that this sanction adds to the actions of fight corruption and to the impunity that the federal agency has carried out, among which are the disqualification of Rosario Robles, titleholder of the Sedatu; the dismissal of the director of a subsidiary of Pemex and penalties for more than 7 thousand 700 million pesos.

“In this way, the Public Service gives a true follow-up to all complaints and investigations, so that whoever commits an irregularity, abuse, omission or irresponsibility, is sanctioned in strict adherence to the regulations,” he added.
