Undersecretary of Justice and recidivism figures: “Half of the people who went through jail, after three years had received a new sentence”

This afternoon the Family Commission of the Chamber of Deputies met, and invited various authorities of the Ministry of Justice to present on the recent events related to the so-called Amber case.

Currently the The main suspect in the death of the minor is her mother’s partner, Hugo Bustamante, who had been on probation since 2016 after serving 11 of the 27 years to which he had been sentenced.

One of the authorities that exposed before the instance was the undersecretary of Justice, Sebastián Valenzuela, representing the Minister Hernán Larraín. Valenzuela explained the context in which conditional liberties are granted in the country, and also gave figures related to the recidivism of people who have been convicted.

In this regard, he detailed that “When you see the data that are available from recent years on recidivism studies, and here I am speaking in general terms, in these analyzes in general there are good recidivism figures ”.

“When early release mechanisms have been decreed, the percentages of recidivism are usually lower than with respect to the people who are required to comply with the full compliance time.”, He added.

Later, citing a study by Fundación Paz Ciudadana and the University of Chile a few years ago, he explained that one of the results of the study “shows a fairly high recidivism of people who spend in jail in general terms. What do I mean by high recidivism? This study found that the people who were released from prison, if they were followed for three years after they were released from prison, half of them had a new sentence ”.

Later, he argued that “what is interesting is when one begins to review the people who relapsed and how they had previously gotten out of jail. And precisely the people who had served their sentence the first time in jail completely, 58% of those people left jail and reoffend ”.

“There was a second system that still exists, which is the sentence reduction system, which in very simple terms discounts months for each year of good behavior, and those who came out with the application of this benefit recidivized 37% “, Held.

Finally, he added, “Those who were released on probation, which were the fewest by the way, re-offended 23%. In other words, we have 58% complete compliance, 37% who came out with a sentence reduction and 23% who came out on probation ”.

However, he warned that “This does not lead to the conclusion that ‘everyone is paroled.’ What it means is that, in general terms, those who are being paroled were repeating less than those who were not being given parole or sentence reductions, but total compliance. “

“In general terms the figures seem to indicate that the target audiences could be well targeted. But that obviously cannot be something that leaves us all alone, because precisely the case that has called this session necessarily calls not to remain obviously calm, ”Valenzuela sentenced.
