During the lockdown following the Covid pandemic, the ‘Pills by Post Scheme’ was implemented in the country to perform abortions at home. In this way, abortion up to 10 weeks is allowed by law to be performed at home using the pill. But the court found that the accused was 32-34 weeks pregnant when she took the abortion pills. Abortion is legal in the UK up to 24 weeks. But after 10 weeks, abortion should be done only in clinics or hospitals under the supervision of a doctor.

The court found that the accused had knowledge of the expiry date of self-abortion using pills. The prosecution had submitted information to the court that the woman had searched online about how to get an abortion without going to a doctor. Taking abortion pills after the due date caused the child’s death prompted the court to take drastic action.

Romsey Southampton North MP Caroline Knox, a Conservative MP, said the 1861 law used to prosecute mother-of-three Carla Foster was out of date. Caroline Knox, who also chairs the Commons Equalities Committee, wants Parliament to debate a review of abortion laws.
