Ministry of JusticeHe tried to prevent independent arbitrator Dirie from reviewing some 100 confidential documents in a court-authorized search of 11,000 files collected on August 8. The Justice Department filed an appeal with the 11th Circuit Court of Appeals.
Cannon Judge“The court finds it inappropriate to accept the government’s conclusions on these important and controversial issues without further review by a neutral third party in a swift and orderly manner,” it wrote in its ruling Thursday.
A spokesperson for the Department of Justice and Trump’s lawyers did not immediately respond to Reuters requests for comment.
Cannon JudgeThe ruling further hampers the Justice Department’s investigation, as a review by the Special Headmaster could prevent the Justice Department from bringing potential criminal charges against Trump.
The judge said Thursday he will direct Dirie to prioritize reviewing classified files. He also ordered him to complete a review of all material confiscated by the FBI by November 30.
On September 8, the Justice Department asked a judge to partially lift its previous restrictions that prevent investigators from reviewing all documents so they can at least continue to review documents marked classified. They also asked the judge to exclude classified files from the Special Master’s scrutiny.
Trump’s attorneys disputed the department’s claim that some 100 documents were actually classified in filing on Monday (Sept. 12), reminding Cannon that the president generally has the power to declassify files.
Raid on the FBIMar-a-LagoAbout two weeks later, Trump’s attorneys tried to appoint a special chief to examine material in the seized files that could contain attorney-client or executive privileges, a legal doctrine that protects some presidential files from disclosure.
Deciding in favor of Trump’s request on September 5, Cannon rejected the Justice Department’s argument that the files belonged to the government and that executive privilege could not be claimed because Trump was no longer president.
On September 9, Trump and the Department of Justice (DOJ) filed a total of four candidates for the special commissioner: Trump’s team proposed Derie and famed Florida attorney Paul Huck Jr. (Paul Huck Jr.). The candidates for the Department of Justice are retired judges Barbara S. Jones and Thomas B. Griffith.
Judge Dirie, 78, was appointed to the United States District Court for the Eastern District of New York in 1986 by then President Ronald Reagan. He held that position for decades, serving as Chief Justice of the Supreme Court from 2007 to 2011, assuming a senior position on April 3, 2011.
On July 2, 2012, Dirie was appointed as a judge at the United States Foreign Intelligence Surveillance Court (FISA) until her term expired on July 1, 2019.
