Trial against ZUE Resident: Controversial Video Evidence Revealed

A ZUE resident must answer to the district court. Surveillance videos put testimony in a different light.

Soest – A resident of the central accommodation facility (ZUE) in Soest is being tried before the Arnsberg district court. He is accused of several crimes. However, the cases do not appear to be quite as clear as the indictment made it out to be.

The allegations against the 35-year-old Algerian weigh heavily: on February 20 and March 1, he is said to have attacked the shop detective at Penny in the south of Soest and various customers. During the crimes on February 20, the detective and a customer who had helped him were injured with a sharp object – presumably a ring with a “stab device”. On March 1, the accused is said to have first attacked someone at the train station and later clashed with several people in the Penny. He is said to have hit an “innocent customer” with a wine bottle. After the crime on March 1, the 35-year-old was arrested and has been in custody in Hamm JVA ever since.

On Tuesday morning, constables led him handcuffed to room 3 of the Arnsberg district court. There the accused had his defense attorney, the Soest lawyer Constantin Kirschbaum, announce that he could not have been the perpetrator on February 20th. Because: The Algerian was in the ZUE at the time of the crime. Because of the painful consequences of an operation, he was unable to set foot outside the door. The act was “completely unknown” to him. Since you can only enter or leave the ZUE with a chip card, it must be possible to prove it, the defendant underlined via his interpreter. The presiding judge, Dr. Johannes Kamp. The accused also claims to have had nothing to do with the incident at the train station on March 1. He did, however, remember the chaos that had broken out at the Penny late that evening. But in a completely different way than he is accused of.

ZUE residents in court: He bursts into tears several times

He shopped at Penny and then smoked a cigarette in front of the supermarket. Suddenly he was spoken to by a group of people in German. He didn’t understand anything. Suddenly he was hit on the head from behind – the laceration was documented. He then fled to the supermarket, the group followed him. “In sheer panic” he tried to defend himself. He also threw a wine bottle. When he shared his memories with the court, the defendant burst into tears several times.

Judge on video recordings: “I find it frightening to see what there”

The defendant’s statement was followed by an assessment of the video material recorded by the twelve surveillance cameras. After viewing the videos, Judge Kamp said, “I find it appalling what is there to see.”

However, he did not find the accused’s behavior alarming: the pictures showed real hunting scenes. Half a dozen people pursued the defendant across the penny. Individuals apparently deliberately cut off the escape route for the 35-year-old. There from the start: the one who is said to have been hit by the defendant with a wine bottle on the arm and who no longer looked as indifferent on the videos as originally thought. During the hunt, the pursuers threw products from the shelves at the accused. The situation escalated at the checkout when the accused arrived at the blocked escape route: the 35-year-old wanted to tear himself away from his pursuers, but they threw him to the ground. The “pack”, as it was called in court, rushed at him. “I see a certain need for investigation there,” commented Judge Kamp.

When the siren sounded from the summoned police, the situation resolved and some of those involved hurried away. Incidentally, the cameras did not record the alleged blow to the back of the head and the associated reason for the defendant to flee into the Penny – the area was not monitored.

The video tapes of the acts of February 20 are also missing from the investigation file. It is doubtful whether they still exist, said the shop detective who was called as a witness. After a few days, the material is usually deleted. The court wants to have checked that by the next day of the hearing.

Defense Attorney: “Do you want to remind the witness again of the duty of truth?”

The detective’s statement was not very illuminating. He claimed of the March 1 case that the “bystander customer” – who is his neighbor, by the way – “kept well out of it.” Because of the knowledge gained from the videotapes, defense attorney Kirschbaum asked the chamber: “Do you want to point out the witness’s obligation to tell the truth again, or should I do it?” The 55-year-old Soester confirmed that he had the impression that the accused was “in Panic” tried to fight back. The second witness – the customer who helped the detective on February 20 – was unsure whether the defendant was also the one who injured him and the detective. The hearing will continue with testimony from other witnesses on August 22nd.
