Commissioner Chuck Putranto present a memorandum of opposition or exception to cases that hinder the investigation into the murder of Brigadier Yosua Hutabarat. Chuck’s team of lawyers said his client was just following orders from his superior, namely Ferdy Sambo.
“The actions that are currently accused of being criminal acts against the accused are purely a form of execution of the orders of superiors and the accused is under pressure from superiors,” said team of attorneys Chuck Putranto in a court trial. South Jakarta District, Wednesday (10/26/2022).
Chuck’s side stated that the CCTV DVR in question was handed over by Chuck to South Jakarta police investigators. For this reason, Chuck’s actions are not considered to be related to the crime of murder.
“The things a quo it is related to the security of the CCTV DVR located at the security post (outside the actual crime scene) and not to the CCTV inside the house and not also as a case of deleting evidence such as clothes, pants, shoes and more on the a crime scene, a murder, “he said.
“The CCTV DVR that was secured was handed over to South Jakarta police investigators, who acted as investigators at the time,” he added.
Chuck’s attorney hopes this objection can act as a counterweight and check on the prosecutor’s material charge.
Chuck is known to have been charged with tampering with CCTV cameras that obstructed the investigation into Joshua Hutabarat’s murder. The act was carried out by the former Chief of the Audit Subsection Bagga when the Deputy Chief of the Propam Police Division was together with five other people.
“The accused intentionally and without rights or against the law has taken any action that caused the electronic system to be interrupted and / or caused the electronic system to malfunction,” said the prosecutor reading the indictment before the South Jakarta District Court (PN Jaksel), Wednesday (19/10).
Chuck was charged with Article 49 in conjunction with Article 33 and Article 48 in conjunction with Article 32 paragraph 1 of Law No. 19 of 2016 relating to the amendments to law no. 11 of 2008 on electronic information and transactions (UU ITE) in conjunction with article 55 paragraph 1 1 of the criminal code and article 233 of the criminal code and article 221 paragraph 1 of paragraph 2 of article 55 paragraph 1 of the 1st penal code.
