To buy a property, you no longer need to go to the notary

REAL ESTATE – The deed of sale of a new or old home can be signed remotely by means of the electronic signature collected by the notary throughout the territory, by virtue of an exemption which will last up to a month after the end of health emergency, according to a decree published in the Official Journal.

This decree of April 3 published on Saturday in the Olympic Games allows notaries to “draw up a notarial deed on electronic medium when one or all the parties or any other person contributing to the act are neither present nor represented”.

“This decree makes it possible to temporarily waive the requirement of physical presence at the notary for the performance of notarial acts”, specify Sunday the Ministry of Justice and that of the Cohesion of the territories in a statement.

This concerns “sales in new as in old” and this “until the expiration of a period of one month from the date of termination of the state of health emergency”, indicates thus the government.

The objective is to ensure “the continuity of the notarial activity, in particular the real estate purchases of the French, while securing the authenticity of the acts in the respect of the health instructions of social distancing” in force to control the epidemic of Covid-19, he concludes.
