In Beek en Donk, a village in Noord-Brabant, rooks’ nests cannot be removed. Council wanted to move the birds’ nests because of the nuisance they cause, but the judge stopped it. The wildlife protection considered that the protected bird should be left alone and successfully went to court.

Local residents are not happy with the decision. “They shit on everything, they scream all day when they’re awake and people slip on the shit they leave on the street,” says a resident of Brabant broadcasting.

“Some people can’t sleep because of the noise the towers make,” says another resident. “They make a lot of noise, especially during the breeding season. All the trucks are completely covered in shit. They also eat all of my empty bird feeders. But we can’t get rid of them.”

To deal with the nuisance caused by the crow, the municipality wanted to move the abandoned nests outside the breeding season from the center to a place outside the town, writes the regional broadcaster. According to the municipality’s tower protection plan, the move would not result in any deterioration of the tower’s condition.

However, the judge considers that the municipality of Laarbeek, which includes Beek en Donk, has not sufficiently demonstrated that the move of the nests will not lead to a deterioration in the status and conservation of the bird population.
