The new tax enters into force. What does this mean for users?

The Sejm decided that VOD broadcasters will donate 1.5 percent of revenues to the Polish Film Institute. The new tax has just entered into force. Will there be a raise?

Entities that provide audiovisual media services will be required to make payments to the PISF account. The amount of payments is 1.5 percent of revenues.

The additional financial source obtained in this way will support film production, organization of festivals and other film events. Currently, they pay a similar fee, including television operators, cinema owners or distributors, i.e. those who make a profit from using the benefits of Polish cinema.

The justification stated that the amendment to the Act of the last day of March on counteracting COVID-19 allowed the premiere release of film material not only in the cinema, but also through other services on demand.

This became the reason for the imposition of the obligation to make contributions to the Polish Film Institute. As added, European law allows for the imposition of such obligations. In addition, the act releases low-income micro-enterprises from their obligations. Thanks to the new regulations, it is only by the end of the current year that revenue of about PLN 15 million will be obtained.

Experts’ opinions are divided, however, most of them think that customers will finally pay for the new tax. – Some suppliers may use this as an excuse to make a raise. However, there is no need to look for bad intentions, 1.5 percent. from the income it is a lot (…) In this case, the final payer are subscribers who will sooner or later feel the fee on their own skin – commented Michał Kozicki, former president of HBO Polska, in a statement for Press.pl.
