His legal representative, Francisco de Borja Gómez Martínez-Fresneda, has confirmed to this newspaper that it was he who advised Mariscal to hand over his children to the court and not to the Civil Guard, to avoid being detained. However, as there was a search and arrest warrant issued on December 31, the court has contacted the agents, who have proceeded to arrest him for parental abduction. “I do not understand this lesson through detention when the judge could have taken a statement from him when he voluntarily appeared in court,” said the lawyer when he learned through this newspaper that his client had been arrested. Gómez Martínez-Fresneda does not see reasons for this decision considering that “there is just cause, so there is no crime” and “neither are the conditions for provisional detention because it is not a serious crime, nor is there a risk of flight , neither of destruction of evidence nor of reiteration ”.

Gómez Martínez-Fresneda justified to this newspaper in December the disappearance of the children and the mother, alleging that the health of the minors prevailed because “vaccines inoculate poison.” The last place where the boys had been seen, until they were handed over to the Seville courts, was in Jerez de la Frontera, where the mother’s partner lives. In all this time, Kau has not had any contact with her children, not even after filing a complaint about their disappearance at the end of December, according to her lawyer.
