EL NUEVO DIARIO, SANTO DOMINGO.- The lawyer, doctor and proponent of the Constitutional Court (TC), José Gilberto Núñez Brun, revealed this Wednesday that some first instance judges do not master the legal figure “amparo”, so the high court I should train them.
“In relation to the appeals for protection, we have a difficult situation with the judges of first instance who do not master the protection and I believe that sooner or later the Constitutional Court is going to have, or through the Council of the Judiciary, to give it an training for judges, because there are judges who do not master amparo,” he expressed.
Núñez Brun expressed himself in these terms when being evaluated by the members of the National Council of the Judiciary (CNM), to whom he explained that appeals for constitutional review are initiated, in principle, against any decision of a court of first instance. or of last resort that are not susceptible to any appeal, and is passed to the TC.
“The importance is that the Constitutional Court, as guarantor of the Constitution and sovereignty, will determine whether fundamental rights were violated in that decision that was made, as it has done many times until now,” he noted.
In another order, the candidate for the high court favored the approval of the vaccine law, whose only obstacle is mandatory nature, since, according to him, they have saved many lives.
“Vaccines are the most there are, but I understand that they are scientific vaccines, like for example, you who are a pediatrician, the pentavalent one, the polio vaccine and those things, they are vaccines that are given from the moment the child is born, but they are given once and is immune for life,” he responded to Bautista Rojas’ question.
In that order, he clarified that the covid-19 vaccine was an experiment and that the Constitution itself prohibits it from being experimented on humans, which is why he stressed that he agrees with the approval of a vaccine law, but of scientific vaccines.
“Not, for example, those types of vaccines that gave one dose, two doses and three doses and still with the fourth dose the covid was there, so you cannot force vaccines that are not from a scientific point of view,” he specified.
At the beginning of his presentation, the mechatronic engineer, lawyer and doctor pointed out that the TC has issued excellent rulings that have set precedents, but it has also decided others that have been “badly present” such as TC/0006/18, which establishes that no All men are not the same.
