The First High Anti-Corruption Court Approves Plea Agreement and Whistleblower Remuneration in Ukraine

It will be noted that today the first instance of the High Anti-Corruption Court approved a plea agreement concluded between the SAPO prosecutor and the former first deputy head of the Kyiv tax service.

The court decision spoke in particular about the payment of remuneration to the whistleblower, which amounts to 13 million 299 thousand 950 hryvnia, which is the first positive decision.

In this case, the verdict can be appealed to the HACC Appeals Chamber within 30 days from the date of its announcement.

“Without exaggeration, this is a historical event that fundamentally consolidates the formation of a culture of whistleblowing in Ukraine and encourages whistleblowers to report facts of corruption that they managed to record,” the NACP notes.

Thus, according to the legislation, the whistleblower will be paid remuneration from the state budget of Ukraine by the state treasury authorities according to the procedure of indisputable write-off.

In 2020, a law came into force in Ukraine that guarantees the right of whistleblowers of corruption to remuneration. At the same time, the document exempts whistleblowers from legal liability for reporting possible facts of corruption if they turn out to be erroneous.
