Annual mobility uses and provisional allocations: on which places? Adaptation of the workforce to actual situations.

The annual mobility, which includes temporary uses and assignments, is arranged both on vacant chairs in the staff of autonomy, which remained after mobility and placements, and on the chairs available in actual staff, therefore not vacant as they are occupied by teachers holders, but who are released for a school year following the leave, political mandate, part-time, annual mobility of the titular teacher, or any other motivation that determines the availability of the chair for the entire school year, from September 1 to 31 August.

Adaptation of the workforce to the actual situation

The adaptation of the workforce to the actual situation takes place according to the rules established for the definition of the workforce and the criteria and methods for determining the availability are defined by the decentralized regional bargaining, as explained in Article 3 of the CCNI.

Before starting the operations of use and prior information to the territorial trade union organizations, the competent Regional Management must prepare the overall picture of the availability of autonomous staff on the posts and the adaptation of the same to the de facto situations, and any subsequent modifications and additions, relating to the different types of posts according to the best use of the staff, according to the principles established by the CCNL

Criteria for determining availability

The criteria for determining the availabilities useful for annual mobility fall within the matters affecting regional decentralized bargaining, as established in art.22 paragraph 3 of the CCNL 2016-18

In the context of availability, as clarified in article 3 paragraph 2 of the CCNI, in addition to the teaching places that may be available in each educational institution, the places derogating from the Constitutional Court ruling no. 80 of 22.2.2010, as well as all the places available for a year in any case foreseen by current legislation, by the positions of the presidency, by part-time, by commands and uses, by inter-compartmental mobility that determine availability.

With regard to the support positions of the II degree secondary school, the availability framework includes the number of staff in law resulting from the application of art. 26, paragraph 3 of the CCNI on mobility of 6/03/2019, in relation to the disciplinary areas, and any exemption places already established.

The availabilities for annual mobility operations also include vacancies or vacancies in the establishment plan resulting from the implementation of project initiatives pursuant to Article 1, paragraph 65 of Law 107/15 (which can only be assigned in the absence of any available and assignable place at provincial level), and the hours remaining in the secondary school of 1st and 2nd grade which, for this purpose, can be combined with available hours both in the same and in another educational institution, in order to constitute chairs or places with a weekly schedule not exceeding that contractually provided, except in the cases provided for by the regulations.

If the number of teachers to be used is less than the availability, the operations of use must be aimed at covering the places that involve a greater financial burden.

The decentralized bargaining at regional level also defines the criteria and methods for using the personnel in the project initiatives, activated pursuant to art.1 paragraph 65 of law 107/2015, already in progress and whose continuation is of recognized relevance educational and social.

During decentralized regional bargaining, the methods for implementing the exchange of professorships or places between spouses also between different provinces are also regulated.

Decentralized bargaining at regional level, in line with the provisions of article 3 paragraph 5 of the CCNI, may possibly define further criteria and methods of use in addition to those provided for in art. 5 of the CCNI, in relation to specific local situations, including, if the conditions still exist, the seismic events relating to the Abruzzo, Marche and Umbria Regions and to the Provinces of Bologna, Modena, Ferrara, Reggio Emilia, Mantua, Rovigo, Rieti with the aim of effectively guaranteeing the right to study, as well as promoting initiatives aimed at adult education.

Availability publication

Following the definition of the available places and before starting the utilization operations, after providing appropriate and adequate information to the trade unions, the overall picture of the availability of the various types of places must be prepared for each province, including places related to the teaching of the Catholic religion.
Trade union organizations must also be promptly informed of any availability available and the reasons for the same.
