The court did not agree to a deal with Dimitar Zhelyazkov-Mityo Ochite. He asked to be sent to a hospital outside the prison only if his remand was changed, reports “Flagman”.

He was diagnosed with covid on February 27, it became clear today in the Specialized Criminal Court. According to the appointed forensic examination, Zhelyazkov suffers from chronic diseases, some of which are the result of the shooting at him in the restaurant “4 you” in 2016.

He had hypertension as well as chronic bronchitis. Mityo Ochite, logically, did not appear at the trial. During the hearing, he was held in a makeshift ward, which was rather an isolation ward, at the Specialized Hospital for Active Treatment of Prisoners (SBALLS) at the Sofia Prison.

The key to the court’s decision was medical expertise.

The chairwoman of the court panel Lilia Georgieva explained that there is a high risk for Dimitar Zhelyazkov due to the accompanying diseases he suffers from, the leading one being hypertension.

According to the expert’s report, in the event of a sharp deterioration, Zhelyazkov could not be treated at SBALLS. Only patients with mild symptoms could be treated in the ward for such infections.

Therefore, the court ordered Mityo Ochite to be sent immediately for treatment to the Military Medical Academy, which is known to be commanded by the President of the National Operational Headquarters (NSS) for Combating Coronavirus, Major General Prof. Dr. Ventsislav Mutafchiiski.

The expert emphasized in the courtroom that Dimitar Zhelyazkov was examined only by X-ray. However, given his chronic illness, this was not enough and he had to undergo a scan, which could help for a much more accurate diagnosis.

However, Mityo Ochite did not have a fever, but he dropped out and had yellow sputum. Its saturation, i.e. the level of oxygen in the blood was normal.

However, the expert warned that in people with chronic diseases, rapid deterioration of the condition and damage to internal organs is possible. There was no way for SBALLS to respond with resuscitation and oxygen therapy. Such patients should be monitored continuously.

A cytokine storm is possible. It can get very bad in just an hour, the forensic expert stressed.

It was recalled that Dimitar Zhelyazkov had several organs damaged as a result of the shooting in 2016, including his lungs.

In such patients, the probability of a severe course of the disease and a fatal outcome is much higher, the doctor explained to the court.

Lawyer Ilian Vassilev said that until now his client had always been treated at the Ministry of Interior hospital tied to the bed. And he asked if this was compatible with adequate treatment with covid. The expert agreed that it would not be appropriate.

We remind you that Vassilev even explicitly quotes Zhelyazkov, who told him that if he was destined to die, it would be better to do so in prison so that he would not be tied to the bed.

That is why the lawyer forwarded the request to his client – if the measure of restraint of house arrest is not reduced, he should be left in prison for treatment.

However, the court did not comply with this. Dimitar Zhelyazkov was left in custody and sent to the Military Medical Academy.

The prosecutor’s office stressed that Mityo Ochite’s condition is still stable and has not deteriorated for almost two weeks. That is why they demanded that he not be transferred for treatment to a hospital outside the prison, with which the court panel also did not agree.

However, the lawyer raised the question of how Dimitar Zhelyazkov will be guarded. No one would allow law enforcement near the covid ward where he would be housed.

The court did not respond to this argument and it was not clear who and how will keep Mityo Ochite in the Military Medical Academy.

The court panel ordered the defendant to be transferred there immediately, if necessary by specialized transport for cases of covid.

Until now, Dimitar Zhelyazkov has been treated with a very powerful broad-spectrum antibiotic, which is used against bacterial infections. Ie in this case, the purpose was probably to treat bronchitis, not the coronavirus, it became clear in court.

A corticosteroid drug was also used to treat the eminent prisoner.

The ruling of the Specialized Criminal Court may be appealed and protested before a higher instance.
