The Consequences of a Lenient Approach: Drunk Driver Who Killed Child Fined BGN 10

The drunk driver who hit and killed a child on a pedestrian path on “Gurko” Street was fined BGN 10 in 2005 after driving while intoxicated.

This is what the former head of the Traffic Police-Sofia, Tencho Tanev, told Nova TV.

“After he was caught, pre-trial proceedings were initiated in the Fifth District Office. Later, for unclear reasons, it was discontinued. He was fined BGN 10 for not carrying his license. He was never punished for driving under the influence of alcohol,” explained Tenev.

“In recent days, we had the opportunity to see how, under the pressure of emotions, the Criminal Code was changed and cars were taken away from people who drive after consuming alcohol. The text was clumsily written. For tens of years, the Bulgarian has been brought up not to respect the law. He does not stop at any sanctions. I have an actual case from my practice. A client of mine was chased by a drunk, criminal man with a knife in his hand who shouted “I’m going to kill you and lay you out”. What car repossession are we talking about? Imagine that someone took a four-wheeled can from a car graveyard and drove it drunk. They will take BGN 150 from him,” commented Emanuil Yordanov, former Minister of Internal Affairs.

“My observations show that this confiscation of the car turns out to be a brake for many drivers to drive drunk. We have a problem with the law. At the moment, we have charged the driver with causing a traffic accident with possible intent, where, however, there is no provision for impounding the car. Their cars are taken when they are drunk, not when they have caused death. A conditional sentence is impunity”, explained Elitsa Buenova, a lawyer in road traffic accidents.

She said that yesterday after the protest, there were several drivers who committed violations, but the police did not pay attention.

“I am worried that they will build a pedestrian crossing and the case will end, as it happened on Slivnitsa Blvd. after the tragedy with Ani and Yavor. Yesterday, after the protest, a guy with dirty gas passed through the intersection. Before that, another made a U-turn at the intersection. I asked him in uniform if he would be stopped and fined. He answered me, “The man has confused the road”, explained Buenova.

“For years we have been appealing for changes to the Penal Code regarding drunk and drugged people on the road. We are shocked by the changes. In recent years, the Prosecutor’s Office has been trying to prove that when you drive while intoxicated, cause an accident and kill a person, this is not a crime of carelessness, but of possible intent,” believes lawyer Iliya Todorov from the Bulgarian Association of Accident Victims .
