The Commissioner’s Office, the Rector of UI Violated the Rules

Constitutional law expert Margarito Thursday assessed the Chancellor of the University of Indonesia (UI) Ari Kuncoro violated the rules contained in the UI statutes for concurrently serving as a commissioner in a State-Owned Enterprise (BUMN)BUMN).

The ban on concurrent positions of Chancellor as a BUMN official is contained in Government Regulation (PP) Number 68 of 2013 concerning the Statute of the University of Indonesia.

Article 35 letter C of the PP Statute of the University of Indonesia states that the Chancellor and Vice Chancellor of UI are prohibited from holding concurrent positions as high-ranking officials in BUMN, BUMD, or private companies.

“The commissioner has the status of a BUMN official. Well, that position was prohibited by the UI Statute earlier. So the UI Chancellor can’t concurrently hold it. Now, in fact, this is concurrently. This is a violation,” Margarito said to CNNIndonesia.com, Wednesday (30/6).

Ari has served as Chancellor of UI since September 25, 2019. In addition to being the Chancellor of UI, Ari is also listed as a vice president commissioner and an independent commissioner at a state-owned bank.

Margarito explained that the Law on BUMN stipulates that commissioners, directors and heads of sections in BUMN are classified as positions or officials.

He considered that the UI Chancellor should be more obedient and submissive to the statutes that have been set. He also questioned that many intelligent people at UI did not see the number one person on campus concurrently serving as Commissioner at this time.

“With this status, the Chancellor as a Commissioner in BUMN violates the statutes. Depends on this, do the smart people at UI want to swallow this violation or what?” he said.

Similarly, constitutional law expert Asep Warlan explained that the positions/officials in the BUMN Law consist of commissioners, directors to functional positions below them.

“So the Commissioner is a department as well, an office as well. In the case of the UI Rector, he cannot serve in the SOE department structure,” said Asep.

Asep stated that the UI statutes had prohibited the chancellor from concurrently serving as a BUMN Commissioner. According to him, the Chancellor at any university should not hold other positions outside the campus. This is inseparable from maintaining the independence and independence of a campus from any interests.

“If he enters public office, he is afraid that there will be a conflict of interest. Then, the chancellor must concentrate on developing his own university,” he said.
