Road offenders are hit with a severe tesla by traffic police if they decide to appeal a fine, and the amount of their fine can increase up to six times.
The reason is that the “Highway Police” choose to collect their debts through private bailiffs, whose fees significantly increase the final payment by the driver.
Practice
The practice emerges from a decision in a court case, about which an offender raised the alarm in the newsroom of ‘Telegraph’. From the document issued by the Ihtiman District Court, it is clear that the IAA citizen has lost the case against the Regional Directorate of the Ministry of Internal Affairs (ODMVR) – Sofia Region. He appealed the BGN 400 fine imposed on him by the police for speeding. However, the court upholds the fine and orders the offender to pay BGN 50 in court costs to the Regional Police Directorate. A fine was issued with an writ of execution for this debt, which was handed over to a representative of the ‘ODMVR.
Debt
From there begins the drama for the debtor. The reason is that, unlike the fine due, which goes to the central budget and therefore directed to the National Revenue Agency for execution, the debt for the legal costs is borne by the ODMVR and its collection remains with the same police force. She, in turn, goes to a private bailiff to collect the debt. Therefore, one day the IAA citizen receives an invitation for the voluntary service from the PSI n. 848 of the capital Rositsa Andreeva. It is clear from the invitation that in addition to the debt of BGN 50, the ODMVR also charged a fee of BGN 150 for legal advice. There are also legal costs for the enforcement case totaling BGN 90. Thus, the BGN 50 obligation becomes BGN 290 in addition to the principal obligation of BGN 400 for infringement.
