Switzerland: A police officer committed a crime of driving – Switzerland: French-speaking Switzerland

The Federal Court (TF) orders the Geneva courts to find the crime of driving against a police officer who had driven at 126 km / h in an area limited to 50 km / h, one night in 2017, while chasing burglars. Information, revealed on Wednesday by “the Tribune de Genève”, was confirmed by the lawyer for the official Romain Jordan.

At first instance, the police officer had been sentenced to a suspended prison sentence for one year as a driver, as requested by the prosecution. This judgment had been reviewed on appeal. The judges dismissed the crime of driving and imposed a suspended monetary penalty on the officer.

The TF today asks the Geneva justice to reconsider the file and to retain the crime of driver. The Federal Court considers that the acts committed correspond to this offense, noted Mr. Jordan. The lawyer noted, however, that the sentence could be reduced, since the author is a police officer, added the lawyer.

According to an extract from the judgment of the TF, quoted by the “Tribune de Genève”, the police officer “knowingly increased his speed while he was in a residential area, thus agreeing not to be able, in in the event of an obstacle or unexpected presence of another user on the road, react in time to avoid an accident or maintain control of your vehicle ”.
