On Friday, the Sejm passed an act that is to tighten the ban on Sunday trading. It will allow the opening of shops providing postal services on non-commercial Sundays if the revenues from this activity exceed 50%. revenues of a given facility. The bill will go to the Senate.

It is about the amendment to the act on restricting trade on Sundays and public holidays and on some other days, for which 272 MPs voted for along with the amendments, 135 were against, 37 abstained.

The trade tightening was supported by 224 MPs from the PiS club, no one was against, 3 MPs did not vote. From the KO club, 1 MP voted in favor and 122 against. From the Left, 29 were in favor, nobody was against, and 17 abstained from voting. Polish coalition: 4 MPs voted for the seal, nobody was against, 15 abstained. Confederation: 5 MPs voted in favor, 4 were against. Poland 2050 – 7 deputies – all voted against. Agreement; 6 people in favor, nobody voted against. Circle Kukiz15: 3 people voted for the bill, 1 was against. 4 deputies from the Polish Affairs circle abstained.

The amendment tightens the ban on Sunday trading so that it is not avoided by shops that provide postal services. According to the draft, only those offices that prove that they actually deal mainly with postal services, and not with retail trade, will be able to operate on Sundays – revenues from postal services will have to account for over 50 percent. other income of the given facility. Among the amendments proposed by the applicants and adopted by the majority of votes, there is an extension of the catalog of related persons whose free assistance on non-trading Sundays will be available to entrepreneurs. They are: apart from the spouse, children, parents, stepmother or stepfather, also siblings, grandchildren and grandparents.

In line with another amendment the Act shall enter into force on the first day of the month following its publication in the Journal of Laws.

The act introducing a gradual ban on Sunday trading entered into force on March 1, 2018. From 2020, the trading ban does not apply only on seven Sundays a year.

The act on the Sunday trading ban provides for a catalog of 32 exemptions. The prohibition does not include, inter alia, postal activities, and also does not apply to: pastry shops, ice cream parlors, liquid fuel stations, flower shops, newspaper shops or cafes. For breaking the Sunday trading ban, the risk is from PLN 1,000 to PLN 100,000. PLN fine, and in the case of persistent violation of the act – restriction of liberty. (PAP)
