sports trial for 11 clubs, including five from Serie A, is underway

For Juve, Naples, Genoa, Empoli and Sampdoria risk maxi fines. Parma and Pisa, specter of penalization or exclusion

It is the day of the sporting trial on capital gains in football: the National Federal Court of the FIGC, chaired by Carlo Sica, will have to express its opinion on the position of eleven clubs and 61 officers accused of alleged administrative offenses. Among the companies involved in the case, five are Serie A: it is Juventus, Sampdoria, Naples, Genoa and Empoli. The others are Pro Vercelli, Parma, Pisa, Empoli, Chievo Verona, Novara and Pescara. All were referred by the federal prosecutor as their own responsibility, pursuant to article 31 paragraph 1 of the sports justice code, to have accounted for in financial reports capital gains and rights to services of players for excess values those allowed by the accounting principles to an extent that affect significantlyfor some of the aforementioned companies, on federal requirements for issuing a national licensethus also violating article 31 paragraph 2 of the sports justice code.

The same clubs were referred by way of direct responsibility (Article 6, paragraph 1) for the acts and behaviors put in place by their top managers with power of representation and for objective responsibility (Article 6, paragraph 2) for the acts and and conduct carried out by top managers who do not have powers of representation.

The trial will open with the formulation of the accusations by the federal prosecutor, led by Giuseppe Chiné, which has developed an algorithm to establish which capital gains can be considered fictitious and to what extent. Parma and Pisa, which according to the accusation would have overestimated the capital gains to obtain the license and register for the championship risk a heavy penalty (but the range of sanctions also includes exclusion from the championship)for the other teams, maxi fines and inhibition of the managers involved are expected.

Afterwards, the floor will pass to the defense of the clubs and managers involved. The trial will then resume on 14 and 15 May, again by videoconference. Much faster times are expected compared to past trials, after the entry into force of the new sports justice code: the device could arrive as early as this Friday. In any case, the goal is to reach the definition of the second level of judgment by mid-May, in any case before the end of the season.
