The Attorney General’s Office (FGR) suffered another setback in the judicial process it is carrying out against the former director of Petróleos Mexicanos (Pemex), Emilio Lozoya Austin, in the Odebrecht case.
And the First Collegiate Court of Appeal in Criminal Matters confirmed the rejection of the banking evidence that the FGR considers key to demonstrating the alleged bribes of 10.5 million dollars that Lozoya Austin received from the Brazilian construction company.
When resolving the appeal that the Attorney General’s Office of the Republic presented against the exclusion of financial receipts from Swiss banks and transfers of resources to offshore companies, which it offered as proof of bribes, the magistrates of the aforementioned Collegiate Court determined to modify the decision of the control judge Gerardo Alarcón López, solely to admit the evidence related to the judicial procedure initiated in New York against Odebrecht, leaving out the banking evidence.

In an intermediate hearing in March of this year, the control judge of the North Prison, Gerardo Alarcón López, did not admit the FGR’s evidence against Emilio Lozoya regarding banking information of the Swiss Confederation and proof of the transfers of resources that Odebrecht, to Through different offshore firms, he made the companies Latin America Asia Capital Holding and Zecapan SA, related to the former director of Pemex, considering that they were obtained illegally by the Public Ministry and banking secrecy was violated.
The Attorney General’s Office, the Financial Intelligence Unit (UIF) and Petróleos Mexicanos (Pemex) can challenge the decision of the First Collegiate Court of Appeal via amparo, by majority vote of the judges, Manuel Bárcena Villanueva and Gabriela Guadalupe Escobar, with Judge Alberto Villanueva voting against.
